       Chief Justice B.R. Gavai emphasized that human dignity gets its true meaning through privacy, autonomy and freedom of choice. He said, “Without privacy, dignity has no existence. Both these values are an integral part of the fundamental constitutional values like the right to life, liberty and self-determination, which are recognized by the Constitution.”

       He further said that the constitutional foundation of this principle is in the Preamble of the Constitution, which guarantees the dignity of every individual and the unity and integrity of the country. At this time, he mentioned Dr. Babasaheb Ambedkar’s concern that ‘fraternity and mutual respect are essential for democracy’ and said that the courts have consistently included the principle of ‘dignity’ in the rights under Articles 14, 19 and 21.

        Citing the judgment on privacy in the K.S. Puttaswamy case, Chief Justice B.R. Gavai said that “Living with dignity is living a true life. Dignity is the unifying core of fundamental rights.”

        Chief Justice Gavai also referred to some of his own judgments, including those on punitive demolitions that take away a person’s dignity.

         He had also ruled on the ban on hand-pulled rickshaws in Maharashtra, stating that the practice was ‘inhumane’ and incompatible with the constitutional promises of social and economic justice.

        Concluding his lecture, the Chief Justice said that the judiciary has seen dignity not just as a right but as a perspective.
