         Following the decision of the Sambhaji Nagar bench, a case has finally been registered against the accused police officers and police officers at Mondha Police Station in Parbhani under Bhandavi Section 103 (1).

        The investigation of the said crime has been handed over to the Pune Crime Investigation Department Police Officer.

       But since this is an organized crime, legal experts say that Bhandavi Section 103 (2) should also be imposed on the accused.

         In the case of the death of son Somnath Suryavanshi, the mother, Mrs. Vijayabai Venkati Suryavanshi, had filed a complaint at Mondha Police Station in Parbhani on 18/12/2024.

          The complaint stated that the Mondha police officers and police personnel continuously beat up his son Somnath Suryavanshi for 3 days, resulting in his death in police custody (outside the court) on 15/12/2024.

         Due to this, Smt. Vijayabai Venkati Suryavanshi had demanded that a case be registered against the concerned police officers and they be arrested.

         However, the Mondha police did not register a case after the complaint of Smt. Vijayabai Venkati Suryavanshi.

       According to the Indian Penal Code (IPC) 2023, Section 103 (1) deals with the punishment of murder. It states that whoever commits murder shall be punished with death penalty or life imprisonment and shall be liable to fine.

Section 103 (1) – Punishment for Murder..

      As per Section 103 (1) of the Indian Penal Code (IPC), if a person commits murder, he can be punished with death or imprisonment for life. Also, he will be made liable to fine.

        Section 103 (1) Earlier, Section 302 of the Indian Penal Code (IPC) was used for the crime of murder, but now according to the new law, Section 103 of the IPC is being used for murder.

Changes in IPC and BNS…

       The IPC, which was in existence for 164 years, has now been discontinued on June 30, and the BNS has come into force in its place. Due to this, some sections have been changed, as well as some new provisions have been included.

         In the Somnath Suryavanshi death case, the leader of the Vanchit Bahujan Aghadi, Prakash Ambedkar, successfully fought the legal battle from the Sambhaji Nagar bench to the Supreme Court. Due to this, a case has been registered against the accused police officers and police personnel.
