        This bill was earlier introduced in the Legislative Assembly by the then Deputy Chief Minister and Home Minister of the state, Devendra Fadnavis. At that time, he had said that the threat of Naxalism is not only spreading in remote areas, but also in urban areas. And this law is being brought to stop this.

        But, there is no clear mention of ‘Naxalist organization’ anywhere in this bill. Instead, only ‘individual’ and ‘organization’ are mentioned. This means that no person or any organization will be able to speak against the government on any issue.

        Not only political parties or organizations, but also journalists, intellectuals, poets, writers, anyone who runs a YouTube channel will not be able to criticize the government’s policies.

          If anyone opposes the government, the government can take action against them under this law. The government had sought objections and suggestions from the people on this law, the last date of which was 1 April 2025.

        Any such act that causes disturbance or disturbance in our society, endangers the lives of people is called ‘illegal act’.

        Unnecessarily causing fights, riots or frightening people. Obstructing government work, such as disrupting work in a court or government office. Threatening police, soldiers or other government employees while they are doing their job. Fighting, damaging public property or creating fear among the people. Using guns, bombs or other dangerous objects or inciting others to use them. Creating obstacles in the way of trains, roads, planes or ships. Which will cause inconvenience to the people. Also, telling people, ‘There is no problem in breaking the law’ or ‘Don’t follow the government’s rules’.

         Collecting money or other things to do all these illegal things. Whether you do this act directly or indirectly or by speaking, writing, making signs or showing any video, photo, etc., all these will be considered illegal acts.

        Any organization that engages in any of the above-mentioned ‘illegal acts’, or encourages, aids or supports such acts, will be considered an ‘unlawful organization’.

         An important point in this is that ‘organization’ means any group, regardless of its name, whether it is registered or not, or whether the rules of that group are written or not. The state government will have the power to declare any such organization ‘unlawful’ directly under this Act. This is why the biggest objection is being raised against this Bill. Because there is a fear that the government can declare anyone ‘unlawful’.

         According to this Bill, anyone who is a member of an illegal organization or participates in the meetings of any such organization or gives or accepts donations to them can be punished with imprisonment for a term which may extend to three years or a fine which may extend to three lakh rupees.

       For other offences committed under this Act, imprisonment for a term which may extend to seven years and a fine which may extend to five lakh rupees can be imposed.

        If a person is helping an organization even though he is not a member of the organization. Then that person has a provision of imprisonment for up to two years and a fine of two lakh rupees.

         Most importantly, all these ‘apprehensible’ means that criminals who commit such crimes can be arrested without a police warrant. And in this, ‘non-bailable’ means that the possibility of getting bail will be low.

         This bill is said to give the administration a lot of powers. If the government thinks that a person or organization is doing illegal activities. Then the government will have the right to arrest them even without any definite definition.

       If the government declares an organization illegal, then the government will have the right to declare it by issuing a government order.

       If a person or organization is declared ‘illegal’, then the government will have the right to take possession of the land and property used by them for these activities. This can also include a person’s house.

       If the seized items are animals or perishable goods, the Commissioner of Police has also been given the right to sell them.
