Complaints have been filed with important officials of Chandrapur district against Mr. Swapnil Yavale, who filed a false complaint at Bhisi Police Station against journalists…. — Have all the officials of Chandrapur district studied Article 51 (a) of the Constitution of India regarding the fundamental rights and proper duties of citizens? — When did the officials forget that all Indian citizens have the fundamental right to protect all national property and mineral resources as per the Indian Constitution?

          Instead of taking appropriate criminal and penal action immediately against the thieves who are illegally mining sand in the Chimur taluka and Mauja Pimpalgaon river basin, “it is clear from the sand mining case in the Mauja Pimpalgaon river basin that they are being protected by the officers of the Chimur Revenue Department and the officers of the Police Department.

          On the night of April 21, 2025, the residents of Mauja Pimpalgaon caught two highways and a pokland filling the highway with sand and called journalists to the scene for legal assistance.

          Some journalists went to the scene and journalist Vilas Mohinkar gave the true information about the incident to all the concerned officials of Chandrapur district including MLA Sudhir Mungantiwar.

           But the citizens of Mauja Pimpalgaon present at the sand ghat were not getting the required legal and good-duty cooperation from the officials under Chandrapur district.

         Illegal sand mining in Mauja Pimpalgaon The journalists who went to the site of the sand extraction incident did not make any contact with Mr. Swapnil Yavale and did not meet him in person or do not know him at all.

             In such a situation, it must be said that it is an illegal act of duty for the same person to make false allegations based on untruths against honest journalists of Chimur taluka and file a false complaint with Bhisi Police Station.

         Similarly, without taking the statements of the citizens present during the illegal sand extraction in the Pimpalgaon riverbed of Mouja and without submitting the sand filling material to Bhisi Police Station, how can the Bhisi Police give too much importance to Mr. Swapnil Yavale? This is the riddle in the bouquet.

        Mr. Swapnil Yavale filed a complaint against two journalists. One of them, being from Nagpur, was not at the scene at all during the incident. And even after that, he was not in the Chimur area.

         This has made it very necessary to conduct a thorough and in-depth investigation into the false complaint given by Mr. Swapnil Yavale to Bhisi Police Station and his entire mentality under all mechanisms and systems.

        They have stated in the complaint that, as per Article 51(a) of the Constitution of India, it is the responsibility of every citizen, including the government and administration, to protect mineral resources like sand and other national assets.

          Similarly, since Mr. Swapnil Yavale, an unknown person, made false allegations against the applicants and filed a false complaint at the Bhisi Police Station, it is demanded that he be investigated with all legal powers and appropriate criminal action be taken against him for filing a false complaint against the applicants.

         At the same time, it has been learned that Mr. Pradeep Ramteke, the Chief Editor of Dakhla News Bharat Web Portal and former Vidarbha Vice President of Maharashtra State Journalists Association, former Maharashtra Executive President of Narwade Global Human Rights, did not come to the sand mining site in the Pimpalgaon riverbed in Mouja and did not know any of the people at the site, and his name has also been listed as an unknown accused. It is impossible not to realize how false the complainant is.

       Complainant Vilas Mohinkar has given true information in the application, and on Monday night, on 21 April 2025, he went to the Pimpalgaon, Chimur taluka in Chandrapur district. The sand in the riverbed has been filled in 2 highways through Pokland, and despite calling the concerned officials, they have not come to the spot, I was informed through my mobile phone.

         Based on the information of the said person, I, following the duty concept of a journalist, reached the sand extraction site in the riverbed at Mouja Pimpalgaon with a companion and got the real information about the incident from many youths present.

        After getting the information, I myself called former minister and MLA Sudhirbhau Mungantiwar, Chandrapur District Collector Vinay Gowda Saheb, Chandrapur District Superintendent of Police Sudarshan Mukkama Saheb, Chimur Sub-Divisional Officer Kishore Ghadge Saheb, Chimur Sub-Divisional Police Officer Rakesh Jadhav Saheb, Chimur Tehsildar Shridhar Rajmane Saheb, Bhisi Thanedar Jitendra Chande Saheb and informed them about the illegal sand extraction and Pokland and two highways.

         After some time after giving the information, when I tried to talk to the same respected responsible officer again, I experienced that many officers had switched off the phone.

         But Chimur Sub-Divisional Officer Kishore Ghadge Saheb and Chimur Sub-Divisional Police Officer Rakesh Jadhav Saheb said that they would contact Bhisi Police Station and ask them to take action.

         Some time later, at night, Bhisi Police Station Bit Jamadar Vijay Bagde along with the driver of Bhisi Police Station came with the constables and deposited two highways filled with sand at Bhisi Police Station.

        However, the Pokland through which the sand was filled in the two highways was not deposited. It is known that the said Pokland has not been deposited yet.

         I have no idea who the owners of the said Pokland are and where they are. If the said Pokland had been deposited at Bhisi Police Station on time, the full name of the Pokland owner and his address would have been known.

         Many citizens of Mauja Pimpalgaon were present in the riverbed of Mauja Pimpalgaon. They said that sand filled up in two canals on Monday, April 21, 2025, at midnight.

         As a journalist, I and other journalists are going to the actual site for news collection and are working on truth-based news collection. Our duty of truth-based news collection is to help the government and administration. It is also to protect and preserve national property.

Very important points in the complaint…

         Under fundamental duties, as per Article 51 (a),(g) of the Constitution of India, all citizens of the country have the right to protect and improve the natural environment including forests, lakes, rivers, and wildlife and to be kind and understanding towards the animals.

         Similarly, as per Article 51(a),(h), all citizens of India have also got the right to protect public property and to refrain from violence.

          According to this right, the applicant has the right to protect the rivers and the sand and mineral resources in the riverbed as a dutiful Indian citizen.

Important point in the complaint…

        Mr.Swapnil Yavale is not known to me (the applicant) and our senior officer Pradeep Ramteke Saheb at all.

            Along with this, since Mr.Swapnil Yavale is a stranger to me and Pradeep Ramteke Saheb, there is no connection between him and me on mobile.

           In this situation, the complainants have firmly stated that Mr.Swapnil Yavale has knowingly filed a false complaint against the applicant and Pradeep Ramteke Saheb through some officials of Chimur taluka and some BJP office bearers to prevent the local authorities from taking appropriate action on the Pokaland or the sand-filled highway.

          Therefore, criminal and other legal action must be taken against Mr. Swapnil Yavale, who filed a false complaint against the applicants at the Bhisi Police Station, Mouja, Chimur taluka under Chandrapur district, without wasting time.

           Similarly, journalist Vilas Mohinkar has requested the authorities that in order to save himself from all legal action, Mr.Swapnil Yavale has misled the government and administration by filing a false complaint against the applicant on Tuesday, April 22, 2025, at the Bhisi Police Station.

             Along with this, they have tried to deceive the applicants by filing a false complaint. This is a serious crime.

          Due to this, I have requested all the officers to initiate criminal action against the non-applicant Mr.Swapnil Yavale under various sections.

           There is a possibility that the case will also be brought to justice under a public interest litigation based on complex issues.
